How foreclosure sales work in Franklin County

Franklin County follows the statewide calendar for trustee sales: auctions under a deed of trust are held on the first Tuesday of each month, between 10 a.m. and 4 p.m., at the spot the Commissioners Court has designated at or near the courthouse in Mount Vernon. Bidding is public and usually cash or certified funds.

Where the Franklin County sale is held: the Commissioners Court designates the sale area at the courthouse in Mount Vernon and records that designation in the county real property records; each notice of sale also states the county and the earliest time the sale will begin. Check the notice and the County Clerk before you go.

Notices must be filed with the Franklin County Clerk and posted at least 21 days before the first-Tuesday sale. For the official copy of any notice, go to the clerk's Franklin County foreclosure notice page; AuctionEmber compiles from these public filings. Property-tax sales in Franklin County are a separate process run by the sheriff or a constable after a court judgment.

Many posted sales never happen: borrowers reinstate, lenders postpone, or the notice is withdrawn, sometimes on the morning of the sale. A trustee sale also generally transfers the property as is, with no inspection and no title guarantee.

Due-diligence tip: before bidding, pull the recorded documents for the property from the Franklin County Clerk and check for senior liens, unpaid property taxes and HOA claims, which may survive the sale. Confirm the sale is still on with the trustee the day before.
