How foreclosure sales work in Edwards County

Foreclosure auctions in Edwards County are set by state law rather than by each lender. Texas Property Code §51.002 puts non-judicial trustee sales on the first Tuesday of the month, from 10 a.m. to 4 p.m., in the area designated by the Edwards County Commissioners Court in Rocksprings.

Where the Edwards County sale is held: the Commissioners Court designates the sale area at the courthouse in Rocksprings and records that designation in the county real property records; each notice of sale also states the county and the earliest time the sale will begin. Check the notice and the County Clerk before you go.

The Edwards County Clerk is the official record keeper: each notice of sale has to be filed there and posted at the courthouse 21 or more days ahead of the auction. You can read the current filings on the county's own page: official Edwards County foreclosure page. Property-tax sales in Edwards County are a separate process run by the sheriff or a constable after a court judgment.

Many posted sales never happen: borrowers reinstate, lenders postpone, or the notice is withdrawn, sometimes on the morning of the sale. A trustee sale also generally transfers the property as is, with no inspection and no title guarantee.

Due-diligence tip: before bidding, pull the recorded documents for the property from the Edwards County Clerk and check for senior liens, unpaid property taxes and HOA claims, which may survive the sale. Confirm the sale is still on with the trustee the day before.

This is general information, not legal, financial or investment advice. Talk to a Texas real-estate attorney before you bid.
