How foreclosure sales work in Van Zandt County

In Texas, most home foreclosures are non-judicial. A trustee named in the deed of trust sells the property at a public auction, and under Texas Property Code §51.002 those sales happen on the first Tuesday of the month between 10 a.m. and 4 p.m., in an area of the courthouse in the Van Zandt County seat chosen by the Van Zandt County Commissioners Court.

At least 21 days before a sale the notice of trustee sale must be posted at the courthouse and filed with the Van Zandt County Clerk, which makes the clerk the official source. The clerk publishes posted notices online here: Van Zandt County foreclosure notices. Property-tax sales in Van Zandt County are a separate process run by the sheriff or a constable after a court judgment.

A posted notice is not a guarantee of an auction. Loans get reinstated, sales are postponed, and notices are re-filed for a later month; whatever sells is sold as is, without warranties.

Due-diligence tip: before bidding, pull the recorded documents for the property from the Van Zandt County Clerk and check for senior liens, unpaid property taxes and HOA claims, which may survive the sale. Confirm the sale is still on with the trustee the day before.

This is general information, not legal, financial or investment advice. Talk to a Texas real-estate attorney before you bid.
