How foreclosure sales work in Ellis County
In Texas, most home foreclosures are non-judicial. A trustee named in the deed of trust sells the property at a public auction, and under Texas Property Code §51.002 those sales happen on the first Tuesday of the month between 10 a.m. and 4 p.m., in an area of the courthouse in Waxahachie chosen by the Ellis County Commissioners Court.
Notices must be filed with the Ellis County Clerk and posted at least 21 days before the first-Tuesday sale. Tax-foreclosure auctions follow a court judgment and are handled by the sheriff or a constable, not a trustee.
Expect churn. A large share of noticed properties are cancelled or postponed before auction day, and buyers at a trustee sale take the property as is, usually without access to the inside.
