How foreclosure sales work in Guadalupe County
In Texas, most home foreclosures are non-judicial. A trustee named in the deed of trust sells the property at a public auction, and under Texas Property Code §51.002 those sales happen on the first Tuesday of the month between 10 a.m. and 4 p.m., in an area of the courthouse in Seguin chosen by the Guadalupe County Commissioners Court.
At least 21 days before a sale the notice of trustee sale must be posted at the courthouse and filed with the Guadalupe County Clerk, which makes the clerk the official source. The clerk publishes posted notices online here: Guadalupe County foreclosure notices. Tax-foreclosure auctions follow a court judgment and are handled by the sheriff or a constable, not a trustee.
Expect churn. A large share of noticed properties are cancelled or postponed before auction day, and buyers at a trustee sale take the property as is, usually without access to the inside.
Due-diligence tip: treat any list, including ours, as a starting point. Read the full notice at the Guadalupe County Clerk, look for other liens and back taxes, drive by the property, and verify the sale status with the trustee before auction day.
