How foreclosure sales work in Cass County

Cass County follows the statewide calendar for trustee sales: auctions under a deed of trust are held on the first Tuesday of each month, between 10 a.m. and 4 p.m., at the spot the Commissioners Court has designated at or near the courthouse in Linden. Bidding is public and usually cash or certified funds.

Where the Cass County sale is held: the Commissioners Court designates the sale area at the courthouse in Linden and records that designation in the county real property records; each notice of sale also states the county and the earliest time the sale will begin. Check the notice and the County Clerk before you go.

The Cass County Clerk is the official record keeper: each notice of sale has to be filed there and posted at the courthouse 21 or more days ahead of the auction. You can read the current filings on the county's own page: official Cass County foreclosure page. Tax-foreclosure auctions follow a court judgment and are handled by the sheriff or a constable, not a trustee.

A posted notice is not a guarantee of an auction. Loans get reinstated, sales are postponed, and notices are re-filed for a later month; whatever sells is sold as is, without warranties.

Due-diligence tip: before bidding, pull the recorded documents for the property from the Cass County Clerk and check for senior liens, unpaid property taxes and HOA claims, which may survive the sale. Confirm the sale is still on with the trustee the day before.

This is general information, not legal, financial or investment advice. Talk to a Texas real-estate attorney before you bid.
